IP Infringement Policy

🢠All intellectual property rights in JewelSoft — including software, brand, design, data structures, and algorithms — are exclusively owned by OmniServe Intelligence Pvt Ltd, incorporated under the Companies Act, 2013. Any infringement shall be pursued under applicable Indian law.
OmniServe Intelligence Pvt Ltd takes intellectual property rights very seriously. Infringement of our IP or misuse of third-party IP through our platform may result in immediate account suspension and legal action.
1. Ownership of Intellectual Property
OmniServe Intelligence Pvt Ltd is the sole and exclusive owner of all intellectual property associated with JewelSoft, including:
- Software & Source Code: Protected under the Copyright Act, 1957 as literary works
- Brand Name & Logo: "JewelSoft" and associated marks are trade marks of OmniServe Intelligence Pvt Ltd under the Trade Marks Act, 1999
- Database Rights: Platform data structures and compilations protected under the Copyright Act, 1957
- UI/UX Design: Visual design elements, layouts, and user interface components protected as artistic works
- Business Methods & Algorithms: Proprietary workflows may be protected under the Patents Act, 1970
2. Prohibited Activities
- Copying, reproducing, or distributing JewelSoft's source code, design, or platform features without written authorisation from OmniServe Intelligence Pvt Ltd
- Reverse engineering, decompiling, or disassembling the JewelSoft application
- Creating derivative works based on JewelSoft's proprietary software or design
- Using the JewelSoft name, logo, or brand identity without prior written permission from OmniServe Intelligence Pvt Ltd
- Uploading or sharing third-party content through our platform without owning the required IP rights
3. Third-Party Content on Platform
Registered users who upload jewellery images, product descriptions, or other content to JewelSoft represent and warrant that:
- They own or have a valid licence to all such content
- Such content does not infringe the copyright, trade mark, patent, or other IP rights of any third party
- OmniServe Intelligence Pvt Ltd shall not be liable for any third-party IP infringement arising from user-uploaded content
4. Reporting IP Infringement (Takedown Notice)
If you believe your intellectual property rights have been infringed on the JewelSoft platform, submit a written complaint to support@omniserveai.com containing:
- Your full name, contact details, and description of the IP right you own
- Clear identification of the infringing content and its location on the platform
- A good-faith statement that the use is not authorised by the IP owner or applicable law
- A statement of accuracy and authorisation to act, under penalty of law
- Your physical or electronic signature
OmniServe Intelligence Pvt Ltd will acknowledge complaints within 48 hours and act within 7 business days, per the intermediary liability framework under Section 79 of the IT Act, 2000 and IT (Intermediary Guidelines) Rules, 2021.
5. Counter-Notice
If you believe your content was removed in error, you may file a counter-notice. OmniServe may reinstate content if a valid counter-notice is received and no legal action is initiated by the complainant within 15 days.
6. Repeat Infringer Policy
OmniServe Intelligence Pvt Ltd will terminate accounts of repeat infringers consistent with the IT Intermediary Rules 2021.
7. Legal Action
Wilful infringement of OmniServe Intelligence Pvt Ltd's IP may result in civil and criminal proceedings under:
- Sections 55 & 63 of the Copyright Act, 1957
- Sections 134 & 135 of the Trade Marks Act, 1999
- Sections 43 and 66 of the IT Act, 2000 (digital IP theft)
